AGAINST A FORMER MARINE... THE SANTA FE COUNTY SHERIFF ANNOUNCES A CHANGE SO TOW TRUCK DRIVERS ARE NOT PICKING UP POSSIBLE EVIDENCE AT CRASH SCENES. IT'S BECAUSE OF THAT CRASH WHERE FOUR TEENS WERE KILLED BY A SUSPECTED DRUNK DRIVER. JOE VIGIL IS HERE TO TELL US ABOUT THE CHANGE. THE SHERIFF SAYS IT'S THE TOW TRUCK DRIVER'S RESPONSIBILITY TO PICK UP DEBRIS BEFORE TOWING CARS AWAY. BUT HE DOESN'T WANT THEM PICKING UP ITEMS THAT COULD AFFECT A CRIMINAL CASE. TO MAKE SURE INVESTIGATORS ARE THE ONES COLLECTING POSSIBLE EVIDENCE, AND NOT TOW TRUCK DRIVERS, DRIVERS WILL NOW HAVE SOMEONE WITH THEM WHILE CLEANING UP DEBRIS AT WRECKS. '...we're putting in place protocol where we will go through, along with the tow truck driver, and if we find items like this we will take them into custody and not place them back into one of the vehicles.'THE SHERIFF SAYS THE TOW TRUCK DRIVER PICKED UP ITEMS AND PUT THEM IN SUSPECT SCOTT OWENS S-U-V. BECAUSE THE TEENS' CAR WAS TORN OPEN. THAT WOULD CERTAINLY PEAK THE INTEREST OF ANY DEFENSE ATTORNEY TRYING TO POKE HOLES IN THE CREDIBILITY OF EVIDENCE GATHERING. 'The property that the tow truck driver picked up and put in the vehicle really would not necessarily be evidence tied to a criminal act.' THE ITEMS INCLUDE CRASH SURVIVOR AVREE KOFFMAN'S I- D, A NOTEBOOK AND WHAT'S DESCRIBED AS A BRIEFCASE. THINGS THAT MAY HAVE BEEN MISSED IN A DEBRIS FIELD THAT STRETCHED AT LEAST A HUNDRED FEET. BUT THE SHERIFF IS NOW SAYING THE DRIVER DID NOT TOUCH BEER CANS AND SOME SUSPECTED MARIJUANA FOUND IN OWENS VEHICLE. 'Just to make sure thought all that evidence will go to the state crime lab and will be processed for finger prints DNA and any other evidence that could tie the evidence we found to which car it goes to.' WE'VE LEARNED THAT INVESTIGATORS JUST FOUND THOSE ITEMS ON MONDAY--8 DAYS AFTER THE WRECK. THE SHERIFF SAYS WITH SO MUCH GOING ON AT THE SCENE THE DEPARTMENT DECIDED TO SEND THE CAR TO ITS IMPOUND LOT AND CHECK IT LATER. AS FAR AS THE NEW PROTOCOL---THE SHERIFF SAYS DEPUTIES HAVE ALREADY
