people in one albuquerque neighborhood are stuck in a confusing situation. they don't know whether to follow the city's parking rules or their homeowner association's policy. jeff maher is live near louisiana and paseo del norte to explain. minute thumbnail 10:04 pm jeff. dozens of neighbors in the eagle pointe subdivision have gotten parking tickets for things like this -- parking your car in the driveway but having it overlap the sidewalk. but those neighbors say they're left with no choice because of the homeowners association rules. john and kevin d'ornellas are two brothers who are caught between a rock and a hard place. they say at night, the homeowners association does not allow them, or anyone else in neighborhood to leave vehicles on the street -- so emergency crews can get through. that leaves some homeowners cramming their cars and trucks in the driveway. there's not enough room -- so sometimes they overlap the sidewalk and partially into the street. at night -- neighbors say an albuquerque police officer has been coming by and issuing parking tickets up and down the neighborhood "this is where i live, this is my driveway, i understand the sidewalk might be city property but we try to follow the rules, and if our homeowners association sets certain rules, that's minute thumbnail 10:05 pm what we follow" the d'ornellas brothers have gotten at least four parking tickets together -- costing twenty- bucks a piece. their friends have been cited as well. they say fighting a ticket in court costs more in court fees than the ticket itself. so, they, along with dozens of other neighbors complained to the homeowners association they were told that a-p-d does not have jurisdiction in the neighborhood, meaning the tickets were not valid. but the whole jurisdictional issue still remains unclear "they need to pick one side, either the homeowners association is right, or apd is right, so one way or another they can't have both rules because they don't mesh together and they're contradictory" neighbors say for now, p
